Who these terms are for

There are two kinds of user. A business owner sets up a business in KitchenPass and pays for it. A team member is invited by a business to record checks and take on tasks. Both agree to these terms when they create an account. Business owners also agree to the parts marked for owners.

What KitchenPass is, and is not

KitchenPass helps a food business record its food safety checks and hand jobs to named people. It is a record-keeping tool. It is not food safety advice, and it does not make a business compliant on its own.

The business is responsible for its food safety management system, for choosing the right checks and temperature targets, and for acting on out-of-range readings. Suggested targets in the app are a starting point; check them against your own procedures and your local authority’s guidance.

Your account

• Keep your sign-in to yourself. Everything done from your account is recorded under your name.
• Record what actually happened. Do not enter readings you did not take or sign off work you did not do.
• You must be at least [MINIMUM AGE] to use KitchenPass.

For business owners: subscriptions

• KitchenPass costs £[PRICE] a month for each business, [INCLUDING OR EXCLUDING] VAT.

For business owners: your team

You decide who joins your business and what role they have. You are responsible for telling your team that you use KitchenPass to keep records of their checks and tasks, and for having a lawful basis to do so. Our privacy policy explains our part. [DATA PROCESSING AGREEMENT]

Your records

The records, photos and other content a business puts into KitchenPass belong to that business. You give us permission to store, process and display them only so we can provide the service. We do not claim ownership of them. Records in the log are kept as they were made and cannot be edited afterwards, so the history stays trustworthy.

AI assistants

You can connect KitchenPass to Claude, ChatGPT or another AI assistant. When you do, the assistant acts with your permissions, and what it does is recorded under your name, as if you had done it in the app. Check what it has set up. The assistant is provided by someone else under their own terms, and we are not responsible for what it says or suggests.

Offline use and availability

The app saves checks on the phone and sends them when it has a connection. A check is only in the business record once it has been sent. We aim to keep KitchenPass available at all times but cannot promise it will never be interrupted, including for maintenance.

Acceptable use

• Do not use KitchenPass for anything unlawful or to harass anyone.
• Do not upload photos of people without their permission, or anything unrelated to the business.
• Do not try to access another business’s data, or to break or overload the service.

Ending your use

You can delete your account at any time; see how to delete your account. We may suspend or close an account that breaks these terms, and will tell you why unless the law stops us. Before a business is closed, the owner can export its records. [CONFIRM EXPORT]

Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, we are not liable for losses a business suffers because of how it runs its kitchen, including fines or enforcement action, and our total liability to a business owner in any year is limited to [LIABILITY CAP, FOR EXAMPLE THE FEES PAID IN THE LAST 12 MONTHS].

Changes to these terms

If we change these terms in a way that matters, we will tell business owners by email at least 30 days before the change takes effect.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
